Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Retryvr's government contracting platform and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our Services.

Account Registration

To use Retryvr, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate and current
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Transmit any harmful code, viruses, or malware
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated systems to scrape or extract data from our Services
• Interfere with or disrupt the operation of our Services
• Resell or redistribute our Services without authorization

Subscription and Payment

Certain features of our Services require a paid subscription:

• Billing: You will be billed in advance on a recurring monthly or annual basis, depending on your selected plan
• Auto-Renewal: Subscriptions automatically renew unless you cancel before the renewal date
• Payment Methods: We accept major credit cards and ACH transfers (Enterprise plans)
• Price Changes: We may change our pricing with 30 days' notice. Changes apply to subsequent billing periods
• Refunds: Payments are non-refundable except as required by law or as stated in our refund policy

If payment fails, we may suspend your access to paid features until payment is received.

Cancellation and Termination

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period.

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion, with or without notice.

Intellectual Property

Retryvr and its Services, including all content, features, and functionality, are owned by Retryvr and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data you upload to our Services. By using our Services, you grant us a limited license to use, store, and process your data solely to provide and improve our Services.

Data and Privacy

Your use of our Services is also governed by our Privacy Policy. By using our Services, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy.

Disclaimers and Limitations

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or completeness of information
• Uninterrupted or error-free operation
• Security of data transmission

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RETRYVR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.

Indemnification

You agree to indemnify, defend, and hold harmless Retryvr and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of our Services or violation of these Terms.

Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Arlington, Virginia.

Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by email or through our Services. Your continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.
